Darkrai and Garchomp can't be level 1, Darkrai lowest level is 50 and Garchomp is 48.

You can use non KB on wifi battle with no problem, but on battle spot only KB Pokemon can participate. I think darkrai is a banned Pokemon on battlespot so I guess it doesn't matter whether it is kb or not. You can use darkrai in wifi battles, just not on battle spot.
